Application Ayruu - Privacy policy

1- Preamble

This privacy policy (hereinafter, the “Privacy Policy“) describes the terms and conditions for the collection and processing of personal data relating to users of the AYRUU online mobile travel aggregator service (hereinafter, the “Service“).

The Service is accessible via the AYRUU mobile application (hereinafter, the “Mobile Application“) and the administration platform or back-office of the Service accessible in SaaS mode, (hereinafter, the “Platform“).

TRIGONE TECH is thus required to collect and process, as part of the provision of the Service, certain personal data concerning the users of the Service (hereinafter, the “Users“).  

The processing of personal data is carried out by TRIGONE TECH SAS, a simplified joint stock company with a capital of €41,930, registered in the Paris Trade and Companies Register under number 812 944 387, whose registered office is located at 38 rue de Berri, 75008 Paris (hereinafter, “TRIGONE TECH“).

As the person responsible for the processing of data, TRIGONE TECH is committed to protecting the privacy of its Users and will do everything in its power to do so. In particular, TRIGONE TECH undertakes to ensure a level of protection of Users’ personal data in accordance with the General Data Protection Regulation, including all French laws and regulations implementing, supplementing or replacing the Regulation where applicable (hereinafter, the “GDPR“).

2- Information for Users

his Privacy Policy allows Users to learn more about the origin and use of their personal information processed when using the Service, and about their rights. This Privacy Policy is therefore important for Users to have a positive experience with the Service and to be able to use it safely, and for TRIGONE TECH to respond accurately and completely to Users’ questions and wishes.

For this reason, TRIGONE TECH makes this Privacy Policy available on the Mobile Application, so that it is easily visible and accessible by the Users, and in particular so that the Users can consult it before subscribing to the Service.

The User is deemed to have read the Privacy Policy and to be informed of the methods of collection and processing of his/her personal data when he/she accesses the Service.

3- What personal data is collected by TRIGONE TECH?

TRIGONE TECH indirectly collects the User’s email address (acting as an identifier) from the User’s company, for the purposes of providing the Service to the User (identification and access to the Service), in the context of the execution of the general terms of use applicable to the User.  

Some features available via the Service (such as the weather forecast) require the activation of geolocation via the User’s terminal. The User must activate geolocation via his mobile terminal. Geolocation data is collected by TRIGONE TECH for the purpose of providing the Service in the context of the execution of the general conditions of use applicable to the User.    

This data is necessary to enable the execution of the contract between TRIGONE TECH and the User. Failure to provide this data will make it impossible for TRIGONE TECH to provide all or part of the Service to the User.

4- Why and on what basis does TRIGONE TECH collect the personal data of the Users?

The User is informed that his/her personal data is collected for the sole purpose of executing the contract between the User and TRIGONE TECH within the framework of the general terms of use.

Thus, TRIGONE TECH collects the data of the Users in order to :

  • Allow the User to access the Service and use its features;
  • Manage and administer the User’s account.

5- Who has access to Users' personal data?

Users who fill in their profile via the Service agree that their personal data may be shared with other Users of the Service, within the framework of the same company, unless the User deactivates this feature.

The personal data of the Users are thus shared exclusively between the Users of the Service, and within the framework of a use of the Service in connected mode only.

TRIGONE TECH does not transmit Users’ personal data to third parties, except to the following recipients:

  • To natural persons authorised by TRIGONE TECH to process such data, after signing a confidentiality agreement, and in particular to TRIGONE TECH employees;
  • To the hosting provider of the Mobile Application and the Service, which stores TRIGONE TECH’s data, including the personal data of the Users, and is obliged to ensure the confidentiality of the data;
  • To any third party in the event of a merger, acquisition, sale of assets or any other form of reorganisation by TRIGONE TECH;
  • To TRIGONE TECH’s external advisors (lawyers, accountants, auditors, etc.) who are bound by an obligation of confidentiality; the competent authorities in the application of the applicable law and/or a court decision.

6- What are the rights of the Users regarding the personal data collected by TRIGONE TECH?

In accordance with the provisions of the RGPD, the User has the right to access, oppose, rectify, limit and delete their data. Where appropriate and depending on the type of data concerned, the User also has a right to portability in accordance with the RGPD. Finally, the User also has the right to define directives relating to the conservation, deletion and communication of their personal data after their death under the conditions provided by the applicable law.

The User may exercise all his rights with TRIGONE TECH by proving his identity:

If the User considers that his rights have not been respected, he may lodge a complaint with the Commission Nationale Informatique et Libertés (CNIL) or with any other competent authority.

7- How is the User's personal data stored and hosted?

Users’ data is kept by TRIGONE TECH for a period that does not exceed the duration of the subscription to the Service. After the subscription period, TRIGONE TECH keeps the User’s personal data for the time necessary to comply with its accounting and legal obligations.

Users’ data are hosted in the European Union in conditions of security and confidentiality of data required by the regulations.

8- What are the procedures for transferring Users' personal data outside the European Union?

No transfer of Users’ personal data outside the European Union is foreseen in the context of the Service. In particular, Users’ personal data is hosted within the European Union.

9- Modification of the Privacy Policy

TRIGONE TECH reserves the right to modify and/or update this Privacy Policy, in which case the User will be duly informed. The revised Privacy Policy will be posted on the Mobile Application with the last date of update.
